According to a report in The San Jose Mercury News, the fatal car accident occurred on Highway 183, near Cooper Road, in Castroville. For unknown reasons, the 41-year-old driver of the Yukon let his vehicle veer into oncoming traffic and crashed head-on into a 2009 Chevrolet Cobalt. The 20-year-old driver of the Cobalt was pronounced dead at the crash site. The driver of the Yukon sustained major injuries. The cause of the crash remains under investigation.</p>

<p><strong>Monterey County Car Accident Statistics</strong></p>
<p>According to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS), 31 people were killed and 595 were injured in car accidents in the unincorporated areas of Monterey County. During that same year, there were 40 fatalities and 1470 <a href="http://www.bestattorney.com/personal_injury.html" target="_blank">personal injuries</a> reported due to Monterey County car accidents.</p>

I trust officials are also looking into whether driver impairment, distraction, fatigue or inattention led to this fatal car accident.</p>

According to a news report in The Lompoc Record, the serious injury accident occurred on Highway 246 west of Campbell Road in Lompoc. Martinez slowed down his 2000 Honda to make a left hand turn when a 1992 Lexus, driven by 22-year-old Jessica Herrera, crashed into the back of his car. The Honda then spun into oncoming traffic and crashed into a 2008 Ford F-150 pickup truck. </p>
<p>Martinez has been listed in critical condition after suffering a collapsed lung and head trauma. Deborah Jenae, a passenger in the truck sustained a broken back and has been listed in stable condition. Kevin Belstler, 51, the driver of the truck sustained moderate injuries and Herrera suffered minor pain in her arms.<span id="more-1308"></span></p>

<p>In spite of California law banning the practice and numerous studies concluding that distracted driving can lead to deadly <a href="http://www.bestattorney.com/california-car-accidents.html" target="_blank">car accidents</a>,  drivers are still texting behind the wheel. According to an Auto Club finding released this week that sampled 4,000 vehicles and drivers in Orange County, 2.7 percent of motorists were observed texting at any given time. That is twice the rate surveyed in January 2009, when California's texting ban went into effect.<span id="more-673"></span></p>
<p>Auto Club officials say the increase in texting and driving shows the need for better enforcement of the law and more severe penalties for those who violate the texting ban. At this time, drivers who are caught texting while driving are fined $20 for a first offense. There are no points added to a driver's record in connection with the violation. SB 1475, which proposed to increase penalty and points to driving records, recently failed to pass in the State Legislature.</p>
<p><strong>Distracted Driving Statistics</strong>  </p>
<p>Distracted driving has caused a great number of fatal accidents and injured thousands of drivers nationwide over the last five years when cell phone use has increased to an all-time high. According to the National Highway Traffic Safety Administration (NHTSA), about 6,000 people died and 500,000 sustained <a href="http://www.bestattorney.com/personal_injury.html" target="_blank">personal injuries</a> in 2008 in nationwide crashes caused by distracted drivers.</p>
<p>California Highway Patrol's statistics also indicate a similar trend. CHP officials say the number of citations issued for hand-held cell phones has increased in California – from 7,779 in July 2008 to 12,761 in July 2009. Since the hand-held law became effective, CHP officials have issued a total of 173,616 citations for violations.</p>
<p><strong>Following the Law</strong></p>
<p>California Vehicle Code Section 23123 (a): "A person shall not drive a motor vehicle while using a wireless telephone unless that telephone is specifically designed and configured to allow hands-free listening and talking, and is used in that manner while driving."</p>
<p>Of all forms of distracted driving, texting is the most dangerous because it takes your eyes off the road, your hands off the wheel and your mind off driving. In the three or four seconds that it takes to send, receive or view a text message, your car travels the entire length of a football field! </p>
<p>As a <a href="http://www.bestattorney.com/california-personal-injury-lawyer.html" target="_blank">California personal injury lawyer</a> who represents injured car accident victims, it is my opinion that distracted drivers should face greater penalties for disobeying this important law. No communication is more important than a life – whether it's your life or the life of someone on the road.</p>

The teen driver of the Subaru, her mother and two other teens in the back seat suffered minor injuries, while another 16-year-old girl sustained major leg injuries. An investigation is ongoing.</p>

Police officials say the brutal dog attack occurred the afternoon of July 25, 2010 when a pit bull terrier attacked the girl. Those who witnessed the incident told officials that the dog owner asked the 7-year-old girl if she wanted to pet the dog moments before the attack. The girl sustained severe facial injuries. Thankfully, she is expected to survive. An investigation is ongoing.<span id="more-581"></span></p>

<p><strong>Dog Bite Statistics</strong></p>
<p>According to Dogsbite.org, a Web site for dog attack victims nationwide, of the 88 fatal dog attacks in the United States in a three-year period between January 1, 2006 and December 31, 2008, 59 percent or 52 incidents involved pit bulls followed by Rottweilers (14 percent), American bulldog and Husky (5 percent each). <p>His step grandfather, Steven Hayashi, 52, has been arrested on suspicion of felony child endangerment and possession of mischievous animals resulting in death. Hayashi's five dogs were euthanized by animal service shortly after the attack. Although Jacob's grandmother and uncle were home, it is not clear whether Jacob was supervised and how or why he got into the garage.</p>

Hayashi had not one, but five ferocious dogs in a house where there were at least two young children. Why was this victim left unsupervised? Why was the garage door not secured at the time? <p>According to the National Highway Traffic Safety Administration (NHTSA), all forms of distracted driving caused 515,000 <a href="http://www.bestattorney.com/personal_injury.html" target="_blank">personal injuries</a> and 5,870 fatalities in 2008, nationwide. The National Safety Council blames 28 percent of car accidents each year on motorists talking on a handheld cell phone or texting while driving. A recent study by Virginia Tech also showed that texting drivers are 23 times more likely to get in a car accident.</p>
<p><strong>The Laws Relating to Handheld Cell Phones</strong></p>
<p>California law prohibits drivers from texting or using a handheld cell phone while driving. According to California Vehicle Code Section 23123 (a): "A person shall not drive a motor vehicle while using a wireless telephone unless that telephone is specifically designed and configured to allow hands-free listening and talking, and is used in that manner while driving."</p>
