Accident News For Attorneys, the Legal Field & the Public
A 45-year-old woman who was killed in a San Diego car accident has been identified by authorities as Edna Virginia Martinez De Cedillo. The North County Times reports that the woman was walking across the street in the 15800 block of Pomerado Street in Rancho Bernardo the evening of November 25, 2009 when she was struck and killed by a vehicle. Martinez De Cedillo was walking with her family, but officials say no one else was hurt in the collision. The driver has not been cited or arrested pending an investigation.
My heart goes out to the family and friends of Edna Virginia Martinez De Cedillo for their devastating loss. I offer my condolences to the family of the woman, who apparently saw one of their own get killed right before their eyes. Tragic! Please keep this grieving family in your prayers.
San Diego Pedestrian Accidents
According to California Highway Patrol's Statewide Integrated Traffic Records System (SWITRS), 25 deaths and 575 injuries were reported in 2007 as a result of pedestrian accidents. Countywide, 51 people died and 1,068 were injured due to pedestrian accidents in 2007. Also, in San Diego County as a whole, 268 people died and 14,641 were injured as a result of car accidents in 2007.
This news report is not clear on exactly where Martinez De Cedillo was crossing the street. Was she in a marked or unmarked crosswalk? Was she at an intersection? If she was at a crosswalk or an intersection, California Vehicle Code Section 21950 requires vehicles to stop and yield right-of-way to pedestrians.
Car Accident Investigations
If I were a member of this victim's family, I'd also want to find out why the driver could not stop in time to avoid the collision? Was he distracted? Was he driving too fast? Was he negligent in any other way? In such cases, it would be in the best interest of victims' families to consult an experienced San Diego personal injury lawyer to find out more about their legal rights and options.
A skilled car accident lawyer will also be able to determine whether a dangerous or defective roadway led to this crash. If that was the case, the agency responsible for maintaining that roadway could also be held responsible for the accident and resulting injuries. Any claim against a governmental entity in California must be filed within 180 days of the accident or injury.
