Accident News For Attorneys, the Legal Field & the Public
A car accident in Ventura resulted in major injuries for a 20-year-old motorcyclist the afternoon of February 13, 2011. The Ventura County Star reports that the major injury accident occurred at the intersection of Wolff Street and Saviers Road in Oxnard, when the motorcyclist was struck by a Chevy Tahoe, which turned left in front of him. The driver of the Tahoe has been identified as 43-year-old Maria Bernardino. The motorcyclist sustained severe injuries and was transported to an area hospital. No arrests have been made or citations issued pending an official investigation.
I sympathize with the critically injured victim of this motorcycle accident. I pray that he recovers swiftly and fully from his serious injuries.
Motorcycle Accident Injuries and Fatalities
There were 11 deaths and 227 injuries as a result of motorcycle accidents in Ventura County, according to California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS). In the city of Oxnard, one person was killed and 15 were injured due to motorcycle accidents in 2008.
Laws and Liability Issues
Under California Vehicle Code Section 21801 (a), drivers who are attempting a left turn or U-turn, whether it is at a street intersection or from a public or private alley, must yield right-of-way to oncoming vehicles. Motorists are required to use extreme care and caution before making a left turn. Major motorcycle accidents often occur when another vehicle is attempting a left turn because drivers of larger vehicles often fail to consciously look out for smaller vehicles such as motorcycles or even bicycles.
If the driver of the SUV is determined to have been at fault, she could be held civilly liable for the victim's injuries. Injured victims can seek compensation for medical expenses, loss of wages, cost of hospitalization, rehabilitation, physical therapy and other related damages. An experienced Ventura personal injury lawyer will be able to better advise car accident victims about their legal rights and options.
