A pedestrian was injured in a San Diego car accident after being hit by a vehicle while crossing the street in San Ysidro the night of March 15, 2010. According to a San Diego 6 news report, the accident occurred on Via de San Ysidro, near the on-ramp to the 5 Freeway. Witnesses say that the pedestrian was hit by a white van, which then fled the scene. The suspect vehicle possibly has roof and windshield damage.

The extent of the victim's injuries is not clear. I hope and pray that he or she did not sustain catastrophic injuries. I wish this injured victim the very best for a speedy and complete recovery.

Pedestrian Accident Statistics

According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were 13 fatalities and 80 deaths involving pedestrian accidents in the unincorporated areas of San Diego County. In San Diego County as a whole, 63 deaths and 998 injuries were reported as a result of pedestrian accidents during the same year.

Hit-and-Run Law

It is not clear where exactly the pedestrian was walking at the time of the collision. Nevertheless, leaving the scene of an accident is a serious crime under California law. According to California Vehicle Code section 20001: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident." The law requires motorists to remain at the scene of an accident irrespective of whose fault the accident was.

Claim for Compensation

The victim in this case would be well advised to contact an experienced San Diego personal injury lawyer who will get them the justice and compensation they rightfully deserve. The family will soon be faced with bills for the medical treatment and hospitalization costs for this victim's injuries. If the driver turns out to be uninsured or underinsured, then the victim could receive compensation through the uninsured/underinsured motorist clause of his or her auto insurance policy or any other policy in the household that he or she has coverage under. A knowledgeable car accident lawyer will also be able to advise the victim about how to proceed with these types of insurance claims, which can sometimes be complicated and challenging.
