Accident News For Attorneys, the Legal Field & the Public
A San Diego car accident left an elderly woman when she was hit by an SUV making a left turn, according to a 10news report. The accident occurred when the 70-year-old woman who has not been identified yet, was crossing at the intersection of Sixth Avenue and E Street. San Diego police said the woman was crossing legally the morning of November 10, 2009 and had the light when the SUV driven by a 50-year-old man, struck her as he made a left turn on E Street from Sixth Avenue in the city's Gaslamp Quarter. Police are continuing to investigate this accident and have not cited anyone or made any arrests. The pedestrian suffered critical head injuries and has been transported to a local hospital.
My thoughts and prayers go out to the family and friends of this elderly pedestrian. This is a truly unfortunate situation for all who knew and loved this car accident victim. I sincerely hope she makes a full recovery.
Deadly San Diego Pedestrian Accident
Based on this report, it seems to me the SUV's driver may be responsible for this pedestrian-car crash and the resulting injuries to the woman. In any accident at a street intersection that involves a collision between a vehicle and a pedestrian it is important to look into who had the right-of-way. If I were a member of this pedestrian accident victim's family, I would want to know exactly what caused this injury collision and whose negligence was a factor.
Police have said the woman had the walk sign when she was crossing the street. If this is accurate information, the motorist here can be held liable for the accident. I trust authorities are also looking into whether this driver was speeding, distracted, driving recklessly, impaired, or otherwise negligent. California vehicle codes are very clear and specific regarding the requirements of drivers approaching street intersections and crosswalks.
