Accident News For Attorneys, the Legal Field & the Public
A motorcyclist sustained severe injuries in a San Diego car accident after he was clipped by a Hummer SUV on the 15 Freeway in Fallbrook. The motorcycle accident occurred the afternoon of December 19, 2009, The Village News reports. The 34-year-old man was trying to get his Honda motorcycle to the side of the road after it suddenly lost power and started to slow down. The motorcycle was then struck from the rear by a Hummer SUV driven by a 51-year-old woman. The impact from the crash caused the motorcyclist to be thrown on to the freeway. The motorcyclist's leg became partially severed and he was taken to the hospital for treatment of major injuries. The driver of the SUV did not suffer any injuries.
I sympathize with this man who has been seriously injured as a result of this accident. I wish him the very best for his speedy and complete recovery. It is not clear based on this article whether his leg had to be amputated. This victim and his family will certainly be in my prayers.

Motorcycle Accident Liability Issues
It seems to me, based on this news article, that the motorcycle had some type of malfunction that caused it to slow down suddenly. Officials say the motorcyclist was traveling at close to 70 mph just before the accident. If I were one of the victim's family members, I would preserve the motorcycle in its current, crashed condition so an expert can examine it carefully for product defects or malfunctions. I'd also be curious to know whether the driver of the Hummer was in any way negligent at the time. Why did she fail to notice the slowing motorcycle?

I came upon this accident just minutes after it happened, the injured rider was laying in the dirt on the right side of the freeway receiving aid from what appeared to be an off duty fireman, his motorcycle lay in the emergency lane on the opposite side of the freeway near the Hummer, though the story doesn't indicate it...I believe he may have possibly been run over by the Hummer or another vehicle in order for him and his bike to end up on opposite sides of the freeway.
