Accident News For Attorneys, the Legal Field & the Public
A 30-year-old man was injured in a San Francisco car accident when his motorcycle collided with a truck, the early morning of August 18, 2011. According to a Bay City News report, the motorcycle accident occurred at the intersection of Lombard Street and Van Ness Avenue in San Francisco. It is not clear what caused the truck to crash into the motorcycle at the intersection. The motorcyclist suffered life-threatening injuries and was taken to the San Francisco General Hospital. An investigation is ongoing.
My thoughts and prayers are with the severely injured motorcyclist. I wish him the very best for a complete and speedy recovery.
San Francisco Traffic Accident Statistics
According to California Highway Patrol’s 2009 Statewide Integrated Traffic Records System (SWITRS), eight people were killed and 358 were injured in San Francisco motorcycle accidents. During that same year, 39 fatalities and 3,405 injuries occurred involving San Francisco car accidents.
What Caused This Motorcycle Accident?
The report does not specify what caused the truck and the motorcycle to collide. There are a number of unanswered questions here. Did either motorist violate California Vehicle Code Section 21453 by running a red light or California Vehicle Code Section 21800 by failing to yield the right-of -way? Was either driver distracted, speeding or under the influence of alcohol? Did the truck driver make a left turn in front of the motorcyclist? These are some of the questions that must be asked in order to determine who is at fault.
According to California Vehicle Code Section 21800 (a): "The driver of a vehicle approaching an intersection shall yield the right-of-way to any vehicle which has entered the intersection from a different highway."
Fault and Liability
If the truck driver is determined to have been at fault, he or she as well as his or her employer could be held liable for the motorcyclist's injuries and damages. Injured victims in such cases can seek compensation from the at-fault party for medical expenses, loss of wages, cost of hospitalization, rehabilitation, and other related damages. An experienced San Francisco personal injury lawyer will be able to analyze all facets of the incident and ensure that the victim's legal rights and best interests are protected.
