A pedestrian accident in San Diego involving a FedEx truck caused major injuries to a 69-year-old man who was attempting to get across the street. The San Diego Union-Tribune reports that the man was struck by the delivery truck while walking in a marked crosswalk at the intersection of Federal Boulevard and 50th Street the morning of June 3, 2010. The victim suffered fractured ribs and a collapsed lung, but he is expected to survive. No charges have been filed against the FedEx truck driver pending an official investigation.

My heart goes out to this pedestrian, who has apparently been seriously injured. I hope he has not suffered catastrophic injuries and pray for his quick and full recovery.

San Diego Car Accidents

According to California Highway Patrol's 2008 traffic accident statistics, there were 81 deaths and 6,123 injuries involving San Diego car accidents. Countywide, 246 people died and 13,527 were injured as a result of car accidents during the same year.

Pedestrian Laws

In this case, it appears that the FedEx truck driver failed to notice the pedestrian in the crosswalk and struck him. California Vehicle Code section 21950 requires motorist to yield right-of-way to a pedestrian crossing a roadway within a marked or unmarked crosswalk or at an intersection. That section also requires drivers to approach any intersection with caution, reduce the speed of the vehicle and take any action necessary to ensure the safety of the pedestrian.

Claim for Compensation

If the truck driver is determined to have been at fault in this case, then he and his employer could be held financially responsible for the injured victim's medical expenses, loss of earnings, hospitalization, surgery and rehabilitation costs. A reputed San Diego personal injury lawyer will stay on top of the official investigation and make sure that the negligent parties are held liable.

What safety tips would you suggest for pedestrians in crosswalks? How can they be more proactive and vigilant and prevent accidents caused by drivers who are simply not watching the road?
