What Caused this Accident?.

Based on this news report, it is tough to tell exactly what the pedestrian was doing on the roadway. The bus driver told officials that she saw the man and tried to swerve to the left. She also told officials that the pedestrian looked up but failed to move away in time. If what the school bus driver said was accurate, then it was the pedestrian's fault for being there in the middle of the roadway. A driver certainly would not expect a pedestrian to be on the roadway, drawing. However, if the man was working or doing something else legitimately on the roadway and if the accident was caused by the school bus driver's inattention, then the bus operator could be held liable for the incident.

Contacting an Experienced Injury Lawyer

In such cases, victims and their families would be well-advised to consult with an experienced San Diego personal injury lawyer, who will stay on top of the official investigation and make sure that their legal rights and best interests are protected. In any case where a government agency is involved, California law states that a claim must be filed within 180 days of the accident or injury. Where negligence or wrongdoing is involved, families of accident victims will be able to file what is known as a wrongful death claim, which seeks compensation to cover funeral expenses, loss of future earnings, loss of love and companionship and other related damages.
