Accident News For Attorneys, the Legal Field & the Public
Kenneth Lindeman, 68, was killed in a Westminster car accident early morning on July 17, 2010. Police officials found him lying on the street at the intersection of Westminster Boulevard and Milan Street. Authorities believe he was hit by a vehicle and that the driver fled the scene. Lindeman was transported to an area hospital where he died shortly afterward. No one has been arrested yet. Anyone who saw this incident is asked to contact Westminster police officials at 714-548-3220.
My heart goes out to everyone who knew and loved Kenneth Lindeman for their tragic and devastating loss. I offer my deepest sympathies to his grieving family and hope they get the answers they are looking for, and the closure they deserve.
Pedestrian Accidents
According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), one fatality and 29 injuries were reported as a result of pedestrian accidents in Westminster. In Orange County as a whole, 31 fatalities and 785 injuries were reported as a result of pedestrian accidents during the same year.
Leaving the Scene of a Crash
Based on this news report, it appears that the driver who struck Lindeman fled the scene of the accident. California law requires motorists to stop and remain at the scene of an accident. Drivers are also required to exchange important information and obtain help for the injured victim. In this case, the driver did none of the above. Had the driver stopped and gotten help for Lindeman and he had received timely medical attention, he may have survived his injuries.
Leaving the scene of an accident is a serious crime under California law. California Vehicle Code 20001 (a) states: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident."
Contacting an Injury Lawyer
In such cases, it would be in the best interests of the deceased victims' family members to contact an experienced Orange County personal injury lawyer, who will stay abreast of the official investigation and make sure that their legal rights are preserved. A knowledgeable car accident lawyer will also advise victims and their families about how their auto insurance policy might apply to a hit-and-run collision or to an incident where the at-fault driver is uninsured or underinsured. The best personal injury law firms will always offer a free and comprehensive consultation to injured victims and their families.
