Motorcycle Accident Statistics
There were 42 deaths and 1,289 injuries involving motorcycle accidents in the city of Los Angeles in 2008, according to California Highway Patrol's traffic accident statistics. In Los Angeles County as a whole, motorcycle accidents claimed 114 people and injured 2,934 during the same year.
Based on this news report, it is not exactly clear how this tragic accident occurred. Did it happen near or at a street intersection? Was the driver making a turn at the time? Who had right-of-way? Whose fault was the accident? Was the driver impaired, distracted or otherwise negligent at the time? Was there a dangerous condition on the roadway, which may have caused or contributed to this fatal motorcycle crash?
Liability Issues
If this accident was the driver's fault, then she could be held liable for the accident and resulting injuries and damages. Where negligence or wrongdoing is involved, families of deceased car accident victims can file a wrongful death claim seeking compensation to cover medical or funeral expenses, lost future earnings, loss of love and companionship, and other related damages.
An experienced Los Angeles personal injury lawyer will be able to explain to victims and their families, about their legal rights and options, and make sure they receive fair compensation. A skilled car accident lawyer will also be able to determine whether a dangerous condition on the roadway caused this accident. In such cases, a claim can be filed against the governmental agency responsible for maintaining that roadway. However, according to California Government Code 911.2, any such claim must be filed within 180 days of the accident or injury.
