Timothy Kalista, 31, was killed in a San Diego motorcycle accident after he lost control of his bike and crashed the morning of April 6, 2010. According to a news report in The San Diego Union-Tribune, the fatal accident occurred when Kalista was riding a motorcycle northbound on the Interstate 805 on the connector to the west Interstate 8. He lost control of the motorcycle and was ejected. He landed about 150 feet below the connector road in the parking lot of a local restaurant. Kalista was pronounced dead at the scene.

My heart goes out to everyone who knew and loved Timothy Kalista for their devastating loss. I offer my deepest sympathies to them, especially to his grieving family. Please keep them in your prayers.

Motorcycle Accident Statistics

According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were 16 fatalities and 355 injuries involving motorcycle accidents in San Diego. Countywide, motorcycle accidents claimed 51 lives and injured 1,081 people during the same year.

Accident Causes

Based on this news report, it is not quite clear what caused Kalista to lose control of his motorcycle. There are more questions than answers at this point. Was this accident Kalista's fault? Was there a vehicle defect or a mechanical malfunction in his motorcycle, which caused him to lose control and crash? Was there a dangerous or defective condition on the roadway, which may have caused or contributed to this fatal motorcycle crash? Were there any other vehicles involved in this accident? For example, was Kalista run off the roadway by another vehicle? I trust California Highway Patrol investigators are examining these and other factors in order to determine who or what caused this tragic crash.

Liability Issues

If an auto product defect caused this accident, the auto maker or the manufacturer of the defective product can be held liable for the accident and the resulting injuries. If a dangerous roadway caused or contributed to this crash, the governmental agency responsible for maintaining that roadway could be held accountable. Please remember that under California Government Code section 911.2, any personal injury or wrongful death claim against a governmental entity must be filed within six months of the accident or injury.
