A woman was fatally injured in a San Diego car accident after she was struck by a vehicle in the Chollas View area. According to a news report in The San Diego Union-Tribune, the woman was hit by a station wagon as she stepped out of her parked car near the intersection of 47th Street and Market Street, early morning on February 19, 2010. The driver of the other vehicle did not stop.

The hit-and-run vehicle was described as an older model blue or purple Japanese-make station wagon. Police say the vehicle should be missing a part of the right front bumper. Also, the passenger front window on the right side is broken. The vehicle would also have some red paint on it from the victim's car. The driver is described as a white man in his 50s with curly white or gray hair.

My heart goes out to everybody who knew and loved this woman. I offer my deepest condolences to her family and friends. They will certainly be in my prayers.

Accident Statistics

According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were 23 fatalities and 533 injuries involving pedestrian accidents in San Diego. Countywide, 246 fatalities and 13,527 injuries were reported in 2008 as a result of all traffic accidents.

Laws and Liability Issues

Leaving the scene of an accident is a serious crime in California. The law requires you to remain at the scene of a crash, whether or not you are at fault. I sincerely hope that this hit-and-run driver who apparently left this woman lying on the roadway, is apprehended and brought to justice. According to California Vehicle Code section 20001: "The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident."

This victim's family would be well-advised to consult with an experienced San Diego personal injury lawyer who will stay on top of the criminal investigation, make sure the family's rights are protected and that they receive just compensation for the damages and loss they have suffered. Where negligence or wrongdoing is involved, families of deceased car accident victims may be able to receive compensation to cover funeral or medical expenses, loss of earnings, loss of companionship and other related damages. A knowledgeable car accident lawyer will also advise the victim's family as to how their car insurance policy applies to a hit-and-run accident or to a case where the at-fault driver is uninsured or underinsured.
