Authorities have identified a woman who was killed in a San Diego car accident as 65-year-old Phyllis Kirk. According to a City News Service report, the fatal car accident occurred the morning of February 23, 2010 when her 2000 Chevy Blazer SUV was clipped from behind by a taxicab on the 5 Freeway. The Chevy Blazer rolled over several times and came to rest on its roof. Kirk died at the scene. The driver of the taxi, 47-year-old Andai Ogbagebri, was not uninjured.

I offer my deepest condolences to everyone who knew and loved Phyllis Kirk. Please keep this victim and her family in your prayers.

San Diego Car Accident Statistics

There were 81 deaths and 6,123 injuries involving car accidents in San Diego, according to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS). In San Diego County as a whole, car accidents claimed 246 lives and caused 13,527 injuries in 2008.

What Caused this Accident?

Based on this news report, it appears that the Chevy Blazer crashed after it was clipped by the taxi. If the taxi driver is determined to have been at fault for this fatal SUV rollover accident, then both the driver and his employer could be held liable for Kirk's wrongful death. Victims and their families, in such cases, may seek compensation to cover funeral expenses, lost future earnings, loss of love and companionship, and other related damages.

Liability Issues

If I were handling this fatal injury case, I'd also look into whether design defects or auto product defects in the Chevy Blazer SUV contributed to Kirk's fatal injuries. A reputed San Diego personal injury lawyer, who has successfully handled auto products liability cases will be able to determine whether design defects in the Chevy Blazer caused it to easily tip over or whether the weak roof caved in and crushed Kirk, causing fatal injuries. In such cases, the vehicle should be preserved so an expert can thoroughly examine it for auto product defects, malfunctions and other evidence.
