Car Accident Statistics

According to California Highway Patrol's 2008 Statewide Integrated Traffic Records System (SWITRS), there were three fatalities and 398 injuries involving car accidents in Tustin. In Orange County as a whole, 152 deaths and 13,414 injuries were reported as a result of car accidents during the same year.

Who Was At Fault?

In this particular case, the news report does not clearly state how or why the car crash occurred. There are several questions here. Did this accident occur at an intersection or near an intersection? Was one of the vehicles attempting to make a turn? Did one of the drivers run a red light or fail to yield right-of-way to the other vehicle? Also, was either driver under the influence, speeding, driving recklessly or distracted at the time of this injury collision? I trust officials are looking into these and other issues in order to determine exactly what happened here.

Liability Issues

In such cases, the driver who failed to yield right-of-way or the driver who is found at-fault for the accident could be held financially responsible for the injuries and damages caused to the other injured victims. Also, victims could seek compensation to cover medical expenses, loss of wages, hospitalization, surgery and therapy expenses, and other related damages.

Injured victims would be well-advised to contact an experienced Orange County personal injury lawyer, who will analyze all facets of the accident and make sure that the negligent parties are held liable. A skilled car accident lawyer will also be able to determine whether there was a dangerous condition on this roadway, which may have caused or contributed to this accident. If that was the case, the city or governmental agency responsible for maintaining that roadway could also be held liable. Under California Government Code section 911.2, any claim against a public entity must be properly filed within 180 days of the accident or injury.
