Accident News For Attorneys, the Legal Field & the Public
A man who was fatally injured in a car accident in Ventura has been identified by authorities as 61-year-old Jose Ramirez Reyes. The Ventura County Star reports that Reyes was northbound on Highway 23 in Fillmore near Bardsdale Avenue the morning of June 29, 2010 when he lost control as he took a curve. His pickup truck then crossed into opposing lanes of traffic, hit a guardrail and rolled over. Reyes died from injuries sustained in this rollover crash. Officials are conducting an investigation.
My heart goes out to everybody who knew and loved Reyes. Please keep them in your prayers.
Rollover Accidents
According to the National Highway Traffic Safety Administration (NHTSA), there are 40,000 traffic accident fatalities in the United States each year. Out of those 40,000 fatalities, about 25 percent or 10,000 involve rollover accidents. Such crashes are usually fatal or result in catastrophic injuries because of the intensity with which they occur.
Causes and Liability Issues
It is not clear from this report whether this accident was the driver's fault or if other factors were involved. We don't know if auto product defects were involved here. There may have been a dangerous or defective condition on the roadway, which may have caused Reyes to lose control and crash. Another vehicle may also have been involved. Each car accident case must be examined thoroughly and comprehensively in order to determine the precise cause.
If this accident was the result of a vehicle defect or an auto product defect, the auto maker or the manufacturer of the defective product can be held liable. If this accident was the fault of another motorist, then he or she could be held liable. In rollover accidents, a lot of times, we observe that seat restraint system failure or roof crush may occur. An experienced Ventura personal injury lawyer who has successfully handled auto product liability cases will be able to utilize an expert in order to determine the role of product defects or malfunctions in a crash.
