Accident News For Attorneys, the Legal Field & the Public
A bicycle accident on a Hemet street resulted in injuries to an 11-year-old boy the morning of July 30, 2010. CBS News reports that the bicycle accident happened when the boy was struck by a vehicle in the 700 block of Arbor Parkway. He was knocked off his bike and dragged a short distance on the roadway before the vehicle came to a stop. Officials say the boy suffered abrasions and road rash. Officials are looking into the cause of the accident.
It is indeed fortunate that this accident did not result in catastrophic injuries. I pray that the child recovers quickly and completely from the injuries he has sustained.
Car Accidents
There were seven fatalities and 416 injuries involving car accidents in Hemet, according to the California Highway Patrol’s 2008 Statewide Integrated Traffic Records System (SWITRS). In Riverside County as a whole, 220 people died and 8,561 were injured as a result of car accidents during the same year.
What Caused this Collision?
Based on this news report, it is not quite clear where the boy was at the time of the collision. Was he riding his bike along the shoulder of the road? Was he riding across the street in a crosswalk? Did he fail to yield right-of-way to the other vehicle? Was there a dangerous condition on the roadway, which may have caused or contributed to this crash? I trust investigators are looking into these and other issues in order to determine how or why this incident occurred.
Fault and Liability
In this case, if the driver was at fault, then he or she could be held liable for the boy's injuries. If a dangerous or defective roadway caused the collision, then the city or governmental agency responsible for maintaining this roadway could also be held liable. Under California Government Code section 911.2, any personal injury claim against a governmental entity must be properly filed within 180 days of the accident or injury.
